Queensland (AFP) - The Supreme Court of Australia on Friday declared the state's state-controlled bank is illegal under a law that the state's attorney general said would "allow banks to take advantage of their special legal rights".
The decision, which was announced in an opinion by the high court's highest court, effectively means that the state's $1 billion bank cannot get away with buying land in Queensland from banks in the state's vast mineral reserve.
The court also upheld the state's ban on issuing money to banks that would be subject to the state's special legal rights.
But on Friday, the high court gave the state time to review the decision and decide whether to continue with the ban.
The decision will be finalised by the High Court on Friday.
The state's Attorney-General, George Brandis, said the decision made by the high court should have been taken before last Friday, when the decision was announced, when the state introduced laws banning banks from holding money from other states.
"The state's attorney-general has already decided that the law in question is invalid and that the high court cannot take up its analysis of the case until after the Supreme Court's decision," Brandis told reporters.
"We expect the decision of the Supreme Court to have a good and constructive effect on Queensland's legal system."
In the case of the state's $1 billion Queensland bank, the high court ruled that the state's law does not apply to banks that hold assets in the state's mineral reserve.
But the Australian Bankers Association, the state's largest financial lobby group, said the ruling should not have made the $1 billion bank liable for selling property
