While Verizon has been busy trying to get the firefighting department to change their data plan, its legal team says that its data throttling policy was just an error. "Verizon's position that its data rate was throttled by Verizon Wireless is completely wrong," said Michael Pippen, a partner in the Fire Department's Santa Clara County civil service team. "Verizon has used this decision to delay our efforts to improve our data service and to prevent the firefighting department from using its existing data rate in the future." A spokesperson for Verizon said the company was "not aware of any other FCC action that could have affected our data policy."

"We have been working with the fire department to reach a solution to prevent this tragedy from happening again," Pippen said. "But now we have to find a way to resolve this problem."

The Fire Department is in the midst of a new effort to fight a wildfire that has killed at least 3,000 people and displaced hundreds of thousands of people. The federal government is expected to release a report early next week detailing the extent of the fire, which is about the size of California's entire state.
