"Uber is using the 'pay to win' formula to justify

"Uber is using the 'pay to win' formula to justify its claims to be able to pay drivers an unlimited number of hours to keep their jobs and to make a living," said Kevin White, Uber's former general counsel. "Their claims are baseless. The plaintiffs make no legitimate legal claims.

"These companies have no business being the sole arbiter of what we do for them," White said. "Uber is not a defendant here. Uber is a participant in an illegal campaign to keep up a system that incentivizes illegal driving."

According to the complaint filed in Alsup's September 7, 2017, hearing, the company claims to be the sole arbiter of what Uber is permitted to do for the sake of profits and does not own "a single copy of any of Uber's operating manuals, manuals or other materials."

The lawsuit is being prepared by the California attorney general's office.
