The lawsuit also claims that city agencies are using the ban and other city ordinances to prevent the city from regulating the scooters, and that the city is violating its own ordinance by refusing to allow the scooters to be used on city properties.
The lawsuit alleges that if Bird are to prevail, the city has violated its own ordinance “in violation of city policy that prohibits the use of city vehicles for private parking. The lawsuit claims that city agencies, including the Los Angeles County Department of Public Works (DLPD), are simply making it clearer to City Hall that they don't wish to use their vehicles for private parking.
The lawsuit also claims that the city of Beverly Hills can be seen as threatening to confiscate public property from Bird.
Bird is now appealing to the U.S. District Court for the Southern District of California, which is currently reviewing the City Hall's motion to proceed.
Bird has since been granted a temporary restraining order in Los Angeles County District Court, which will be heard on December 30, 2018. The city has until February 13, 2019 to file a new civil complaint with the U.S. District Court for the Southern District of California.
