Tesla says the former employees told its former employees that they were using their trade secrets to "improve" Tesla's technology and operations, and that the former employees were also using their trade secrets "to acquire and retain new technology and hardware and vehicles in a way that would enhance their productivity and productivity as well as their quality of life."
Tesla's complaint also alleges that the former employees' use of trade secrets "may have been in violation of California civil laws‡ and ․ [including] California Consumer Credit Act‡. Further, there was insufficient evidence to demonstrate that the former employees were using trade secrets to acquire and retain new technology and equipment and vehicles."
The court ruled that Tesla's trade secrets claim was too broad. "The trade secret claims must be sustained based on the facts, circumstances, and circumstances of each case—whether or not employees and/or other party used trade secrets to acquire, acquire, or retain new technology, or the extent to which information they possessed in trade secret litigation or in use in trade secret litigation was used or obtained without their knowledge," the court concludes.
The California court's order is the latest step in Tesla's ongoing effort to sue Tesla for the misappropriation of trade secrets. In May, Tesla sued a California judge for using the phrase "telecommunications and information storage" on her personal email account when she was trying to find out how to set up and monitor a computer system for tracking Tesla's sales of Tesla vehicles in Nevada. In March, Tesla said it would not settle the trade secrets matter as it would be challenging the state's constitutionality of the law.Welcome to the site of the new blog post by the new editor.
