Swildens said there are several reasons why patent trolls have lost their patent fight in the USPTO's legal battle. First, while most patent trolling is about exploiting a patent, some of the patents don't work. For example, many of the patent trolls in the last decade have worked with a company known as Dyson.

Second, patent trolls have a reputation for exploiting patent trolls' patents to force the patent holders to pay them more, which leads to a much higher cost of litigation. The patent trolls also have to show that their patent claims were not infringed.

Third, patent trolls are also known for their aggressive legal actions against other companies. The USPTO rejected a series of suits that sought to use Google's patent in a separate lawsuit, one that was dismissed under the USPTO's jurisdiction.

Swildens said that he has no doubt that the USPTO will end up overturning all of these patents, but he also believes that the USPTO has a better shot at overturning all of these patent disputes than just relying on the USPTO. "This is a very, very important case and I think that we will have a better chance of overturning many of the patents," he said.

But while the USPTO is happy with the outcome, it has some warning bells: if a patent troll wins a patent, they must show that in the future they should be rewarded with a new product, which could force a new company to seek an extension of the patent. The USPTO's decision may be the tipping point in how patent trolls will respond to a decision by the USPTO to stop using their technology.
