One of the difficulties faced by the digitization process was that it required the production of only a few recordings (the majority of which were recorded before the 1963 date). This meant that some records were very limited in number, and that some of them were quite difficult to recreate. This meant that if the recording was taken before January 1, 1963, it must be digitized before 1 January 31, 2015. In many ways, the record-sharing process has been a very successful one, but the process to do so has involved many changes. The earliest such changes were in December 2012.
When I began to digitize my recordings from February 2014 to January 2016, I was asked by several publicists and researchers to give them their permission to be digitized. They said that if I wanted to create a recording that would "take place between January 1, 2013 and 1 January 31, 2015", the first step was to obtain permission from the copyright holders. The next step was to obtain an agreement from the copyright holders that they would release the material. The next step was to obtain a formal agreement from the copyright holders that I would release the recordings after 1 January 31, 2015. The results, however, were very mixed. For example: one of the most striking examples in my collection was the collection of a recording I made in 1995. If the copyright holders were to decide to release the recording after 1 January 31, 2015, I would have to file a formal agreement with them under the copyright law. So, this was probably the most challenging decision.
Some of these recordings were taken before the 1963 date for example, but others weren't. In some cases, I was asked to provide a copy of a recording I made before the 1963 date in order to obtain permission. In these cases, the process to obtain permission was very complicated and difficult, so I was unable to do so.
For the last couple of years, I have been working to find a way to provide a solution so that the public can use these recordings freely, without interference from the Copyright Office. I think that the current model of digitizing recordings takes some of these issues into account. The goal of this project is to provide the public with a way to get access to a record that would take place as early as January 1, 1963. The first step will be to get an agreement from the copyright holders that they would release the recordings before 1 January 31, 2015. Once this is achieved, I think that I can give the public an opportunity to participate
