In addition to the misstatements, Pai's letter to Wyden and Schatz included an attachment of a copy of a letter from a former FCC CIO to former FCC Chairman Tom Wheeler (D-N.C.). The letter was dated May 26, 2016 from Bray to Bray, but was never sent back to the FCC.

According to the Inspector General report , the FCC's "false and misleading statements to Congress" were "sadistic and duplicative of prior disclosures of its failure to respond to inquiries from Congress on the extent of its compliance with its own statutory requirements, and of the lack of response to the FCC's repeated requests for information."

The FCC's failure to respond to questions about the "DDoS" attacks that never happened "is the first time that a Federal Communications Commission official has testified that this particular incident occurred," according to the report.

The FCC's response to the senators' questions is listed below:

"As you already noted, the FCC has repeatedly repeated its repeated requests for information from Congress. In an April 5th email to Chairman Pai, [sic] he wrote, "I would like to take you on a tour of our website and our office in which we met with you recently, and I hope you will continue to share with us the details of your conversations with the Chairman and Chairman Pai. The Chairman and FCC have agreed to make regular updates to the Federal Communications Commission on our compliance and the response to our inquiries."

In one of their letter to Pai, the FCC CIO said that the first person to use the names and addresses of the two FCC CIO's to respond to the senators' questions was former FCC CEO Tom Wheeler. "Tom, who had previously been Chairman of the FCC from May 2015 to January 2016, had been contacted by FCC Chairman Tom Wheeler to respond to these questions about the DDoS attack that took place during the same time period and was apparently not a part of the commission's response to the inquiry," the FCC CIO wrote.
