If true, the lawsuit, which is also seeking unspecified compensatory damages, may make it hard for Callender to continue his lawsuit. If true, the lawsuit could cause a huge media backlash that could cause the video game industry to shift gears—and maybe not survive the backlash at all.
I think the filing of Callender's lawsuit could very well be one of the most powerful examples of how the online video gaming industry has changed over the last few years.
For now, though, video game companies are not going to be able to stop him, and the suit is likely to get more traction.
The lawsuit is not the first he has filed. Back in January, Callender filed a separate lawsuit against Xbox 360 creator Michael Nutter for harassment. He did so to avoid a $35 million settlement with Nutter, but he also failed to prove he was in actual fact fired. (I guess it's possible that Nutter's actions were just part of a larger pattern here; I'm not sure.) In fact, I'd think that some of those games are probably good enough for Callender to have filed his own suit.You can find many of these here:

I was driving my father's Mercedes Benz about two years ago when my dad was in his mid-40s, and he was on vacation in Europe and wanted to drive the car.
At first I thought it was a joke. "Hey, what the heck are you doing driving a Mercedes."
But he said "You can see in the side mirrors, which look like black and white pictures of the car.
And you can drive it on the side streets."
I said "Uh, no, wait, no I don't drive."
And he said "I've seen that in films before."
