At issue is whether AT&T's mobile-payment system works, according to the FCC's current privacy policy, though the firm said that it is not yet able to comment on the matter. AT&T also said that its mobile-payment software works well, and that the company is continuing to work on other issues related to location-based payment systems.
The FCC's privacy policies also state that consumers have the right to know where the information they buy is, and to request an explanation of how it is being used.
Pai "is an absolute disgrace," said Richard Painter, a former senior legal adviser to President Obama. "He is so intent on stifling consumer privacy that he has allowed the American people to be stymied by such an action."
Asked whether the FCC should regulate the practice, Pai replied that it is part of a broader debate on how best to protect consumers' rights.
"I don't think there's a clear law, and I think it's important to know what we're talking about," Pai said. "It's important to understand what the terms of service is, and what we're trying to do to protect consumers and what we're doing to ensure that the privacy of Americans is protected."
"I don't think you're going to get a free lunch when you have a government regulation that requires you to provide a public record. They don't have to provide that."
