On June 12, a federal court ruled that companies like Verizon can still use the Verizon network through their mobile and tablet-based devices and have set up a new set of rules. Verizon has said it'll seek approval in both federal courts in California and the District of Columbia to continue using the network, and it has said it will appeal the decision.

On December 17, Verizon announced it would begin rolling out the new service's text messaging feature on its own devices. (The company also says the feature will continue to work on its devices after its initial rollout.)

In the meantime, the FTC's ruling comes days before Verizon's next move. In a notice of appeal that Verizon sent to the US attorney's office for the Southern District of New York, the DOJ's legal office suggested that Verizon's complaint will be dismissed if the court rules in Verizon's favor.

As part of its decision Thursday, the FCC said it will decide whether to allow Verizon to continue using the Verizon network.

In a letter to Verizon on Thursday, FTC Director Michael Anton argued that the agency "can't be certain that the content of the text messages is accurate" and that the FCC's decision "is not inconsistent with the fair use doctrine."

And in a separate letter to the FCC, CFO Brian Stelter said that the agency's ruling "contains significant doctrinal guidance that, at the very least, is consistent with Verizon's view that 'text messaging' and 'text-message sharing' are distinct and must be accepted as separate and distinct products."

In an interview, Sprint COO Marcelo Claure said that the FTC has been "very clear" that it will be hearing from Verizon on whether it will appeal the decision.From Star Trek Online Wiki
